DECEMBER 4,2024 Adv Carlos leads Tivim Comunidade Gauncares to file FIR against managing committee for pvt university land transfer
MAPUSA: Gauncares of the Comunidade of Tivim along with villagers and Aldona MLA Adv Carlos Alvares Ferreira filed a complaint demanding FIR against Minguel Caetano Sequeira, President, James D’Souza, Attorney, Joselan Pereira, Treasurer and Pranav Parsekar, Escrivao of Tivim Comunidade for alleged fraudulent grant of 2,00,000 sq mts of Tivim Comunidade land to Maharashtra Academy of Engineering & Educational Research’s MIT Group of Institutions, Pune (MAEER).
The complaint alleges a case of forgery and cheating under Sections 420, 468 & 474 r/w S. 34 IPC with common intention for cheating, for forgery, for knowingly using forged documents as true and misleading the Government in obtaining approval for grant of land without auction.
Addressing the media, Adv Ferreira on Wednesday accused the comunidade managing committee of preparing two sets of minutes — a typed minutes sent to the project proponent and another illegible handwritten minutes sent to the Revenue Department of the government
“Soon after the meeting of February 25 was completed these people sent a typed copy of the minutes — this is the first time I’m hearing of any one, in this case the escrivão sending a typed copy of the minutes even before it is approved. In this typed copy there is nothing written about the rate of the land and the amount of Rs 5-crore that needs to be deposited — it is only said: approved to grant the letter — because it has to go to the government to decide the rate,” Adv Carlos said.
“MAEER then took this letter and submitted it before the IPB,” Adv Carlos added.
“Hiding this fact, they (the managing committee) sent manipulated handwritten minutes to the government. This is completely illegible. But suddenly in the middle in a different legible handwriting there is a rate mentioned of Rs 12.50 per sq m and Rs. 5-crore deposit,” he also said.
“On the government file, the rate of this land is 3,000 per square metre. Even 2,00,000 square metre becomes 600 million rupees and 12.50 is only 5-crore. In the typed meeting, the president has said that they will get the best price and it will be profitable to the comunidade,” Adv Ferreira said adding that the Gauncares will be moving the government with a representation and if necessary the Courts to quash the transfer of land and for registration of FIR if the police do not register.
“We have to put the fear of law in all the minds of people including the escrivao that you cannot play the fool and you cannot deprive the comunidade members of their share of the money,” he added.
